What is
Asbestos?
Asbestos is
a natural fiber that was widely used in construction and other industries until
it was banned in the 1990s because of its association with serious diseases,
including cancer. It is mainly used as insulation and to protect buildings from
fire. These are often found around pipes and boilers, but also in homes,
workplaces, schools, hospitals and public places.
Asbestos is
caused by inhalation of asbestos dust. An asbestos disease can take decades to
develop and the symptoms, treatment and prognosis of a patient vary according
to the type of asbestos a person has.

Asbestos
claims are legal processes taken by someone who has developed asbestos-related

Mesothelioma
Mesothelioma
is the most common tumor in the lining of the lungs. Tumors can appear from 10
to 50 years after exposure to asbestos. This is a deadly disease.
Pleural
thickening
Pleura is
the lining of the lungs. Pleural fibrosis can create a thickening of the layer
which, if it extends, can cause shortness of breath as long as chest activity
and expansion will also decrease. Investigation is done by x-ray and lung function
tests. This condition does not affect life expectancy.
Pleural
plaques
Areas
raised from this transparent fibrous tissue can be seen lining the pleura. They
are caused by regular exposure to asbestos fibers, but generally do not cause
lung damage. Pleural plaques have no effect on life expectancy. As the law
currently stands, no compensation claims can be made if only suffering from
Pleural Plural.
Asbestosis
Asbestosis
can develop as a result of prolonged exposure to asbestos, usually more than 20
years. Symptoms include progressive shortness of breath, clubbing and abnormal
chest sounds. Patients will be exposed to a large amount of asbestos fibers
before experiencing this condition. Investigation was carried out with a
combination of chest x-ray, high-resolution CT scan and pulmonary function
tests. This condition develops slowly, and it can be very troublesome, but
fortunately some patients die from asbestosis.
Lung cancer
People who
suffer from asbestosis or exposure to fiber levels that are likely to cause
asbestosis, can develop lung cancer. Patients who smoke are also more likely to
develop this disease. Death from asbestos-induced lung cancer is approximately
two times more common than mesothelioma.
Helen
qualified as a lawyer in 1998 and since 2003 has specifically helped people
diagnosed with mesothelioma and other asbestos-related diseases get
compensation either through the court system or through the Government, or
other schemes. He joined the Leigh Day office in Manchester in 2015 to form an
asbestos litigation team in the North, after previously spending 15 years
working as an asbestos lawyer for a national law firm, most recently as a
partner in their London office. He has represented victims of asbestos from all

Helen
struggled relentlessly for justice for her clients and was the first lawyer to

Triggers Employer Responsibility" in which the Supreme Court finally ruled

Main cases
Durham v
BAI (leading Case 1 in the Litigation of Triggers for Entrepreneurs) 2012
UKSC14. One of the longest cases that had to be heard by the Supreme Court
since its inception, involved 6 different actions to determine who had to pay
mesothelioma claims based on the current insurance policy. Helen won the
cashing for her clients at all stages. During that case Helen found all records
kept in London, belonging to the accident insurance company Builders, which
contained details of all insured entrepreneurs from the start which had become
a valuable source of information for tracking insurance companies.
Claims in
the name of Mr. W, a former British Railways employee who suffered from
mesothelioma. Accountability is given within 24 hours after the Letter of
Claim, with compensation approved and paid to W in less than four months.
Mrs. B v.
RMD Kwikform Ltd. & Lyndon Scaffolding Ltd. 2006 (not reported) - complex
asbestos-related lung cancer cases which were set to be the first cases to test
the application of the "Helsinki Criteria", in court which is a
complex set of medical rules relating to causes asbestos lung cancer in certain
circumstances. After analysis of negative fibers from a laboratory in Wales,
Helen approached an American laboratory to conduct a second review of lung
tissue followed by claims for a five-digit number.
Claims on
behalf of widows from former carpenters for mesothelioma where there is a
differential diagnosis between mesothelioma (caused by exposure to asbestos)
and synovial sarcoma (not caused by exposure to asbestos). Helen managed to
argue on the examination that the tests performed were preferably mesothelioma
and the cause of her death was an industrial disease. He then obtained an
independent report from a leading pathologist to confirm that it was actually
mesothelioma. Cases are settled with a number of six numbers afterwards.
Compensation
was given in two different cases to two mesothelioma victims widows after
extensive searches for insurance companies from non-existing employers, Henry J
Firman Ltd.
Claim for
Ny. P, a former wife of a furnace repairman who has contracted mesothelioma
from washing her ex-husband's work clothes. Helen managed to track down her
ex-husband who gave detailed statements and produced original plans from
several stoves he had worked on containing asbestos and after that
responsibility was given.
Professional
organizations: Legal Society. Helen is also a Senior Litigator at the Personal
Injury Lawyers Association (APIL) and holds specialist accreditation for claims
of Asbestos Disease. He is one of the few lawyers who can judge other lawyers
who apply for specialist accreditation.
